The primary problem here besides the negative propaganda they provided is that there was no indication or “foot note” to let the public know the status of their presentations by declaring who is sponsoring their advertisements and is it the Journalist talking or the PR speaking? Further, is $250,000.00 (as alleged to have been paid to Williams) adequate pay for their services or is $3,000.00 per month (as alleged to have been paid to Wilson) a fair rate? Which is payola and which is a consultants pay? I hasten to add that a Journalist can also be a “good” PR person only when their presentations are clarified by the foot note declaring the sponsor(s)! Further, how do we look at the support for pay given the G. W. and Jeb Bush position to destroy Affirmative Action and support Voucher Schools by projected Black Leader Dr. D. C. Miller then head of FBRC of Florida. Was this again payola and the sell of Perceived Black leadership or the questionable act of “the-price-is-right” and my conscience and my morals are not that important? Then there are the acts of General Colin Powell and Condi Rice as they took the position of sell the lies that the President used to go to war with Iraq. In fact if any person would take a position against G. W. or Bryant, Armstrong or Wilson would quickly make an attack in defense of their respective sponsors. There is nothing wrong with being a “Hired Gun” if you can live with any violation of your conscience or integrity as a person. But the twist here is where does the position of a “Journalist” and the “Commitments” of a PR contract conflict. When Armstrong Williams was alleged to have been taking Pay for the positions he was taking on issues that G. W. was pursuing he was accused of taking “Payola” This was because he was not being up front with his change from a “Journalist” to a Public Relation “Hired Gin” When he decided to take a position and deliberately tell promote a position not necessarily the truth without identifying his changed role he was taking Payola and not a Journalist. He knowingly supported a lie. For Journalist and PR people there are at least two types of lies to consider. This past week a source/person, who worked at the bank where the FAMU had their accounts described the state of FAMU‘s bookkeeping as full of a variety of acceptable reporting that lack a “uniform format.” It seems that upon receiving FAMU’s individual uncombined accounting books from the various sources the bank declared a FAMU period and placed the banks staff on combining these individual and differently kept books into a “uniform format” for the purpose of reporting the required status. The bank found that although FAMU’s books were not of a “singular uniform format,” however they were easily translated into a uniform document which always demonstrated that the university was most always in the Black!! Yes, FAMU was never in deficit and some people, who were politicizing this as FAMU’s problem knew this. As bad as the disaster produced by hurricane Katrina was, there was the discovery of a even greater disaster that has been ongoing in New Orleans for centuries, that of: the human indifference racism, extreme distance between the wealthy and the poor, and he terrible injustice of industrial pollution of the New Orleans the poor “Bottoms” population. Randy Dotinga noted it like this. “Before Hurricane Katrina even reached New Orleans, scientists warned of a "toxic gumbo" that would fill the giant soup bowl of a city. . . . As the water recedes, a disgusting muck coats the surfaces of buildings and streets. . . ..” (Randy Dotinga , How Vile Is Katrina's Toxic Goo? , Sep. 19, 2005 PT) John Heiloprin (AP), reported . “A new health risk other than that caused by the hurricane (Katrina) emerged Friday from the sediment of New Orleans -- test results showing that diesel and fuel oils, (petroleum products as creosol, pesticides, benzene, dioxin, etc.) which can take years to break down, make up as much as a 10th of the weight of some sediment samples. . . . Earlier tests turned up dangerous amounts of sewage-related bacteria and lead in floodwaters and more than 100 chemical pollutants.” Heavier components of oil and gas have simply sank into the muck, along with chemicals of pesticides and herbicides. Then there's the matter of how little will be told by such agencies as the EPA and FEMA about the full extent of water and soil contamination, at least publicly. Reporters are already complaining that the Environmental Protection Agency (EPA) is resisting Freedom of Information Act requests for details about dangerous chemicals let loose by the storm and flood. The Center for Disease must study the health conditions of the “Bottom” dwellers as compared with the citizens of the rim. This seems to be a classic case of class extermination by “Social Darwinism.” It will help to understand what caused the magnitude of this disaster if we can picture the way this happened. First, we must picture that the city of New Orleans is built in a sort of a bowel located between the Mississippi River, the Gulf of Mexico, and The man made lake, Pontchartrain. The poor and Black in Large numbers lived in the “bottom” of this bowel while the well-to-do lived essentially on the rim. Industry was also located on the rim of the bowel . All the high lands waste from industry and the well-to-do either flowed to the bottom of the bowel as top ground flow or seeped to the bowel under ground. New Orleans always used a series of monster pumps running all the time to keep to levels of liquids in the bowel from drowning the population. However, the ground at the bottom absorbed as much as the ground would hold producing a toxic environment for all the poor and Blacks. who were unfortunate enough to live in the cities bottoms. This was the mud and muck that the hurricane mixed in the clean up after math of this disaster of Katrina Picture the common kitchen coffee maker. The coffee grounds are placed in the filter at the top and water is percolated over the coffee grounds which dissolves or leaches out the dark coffee into the pot located at the “Bottom“. Well New Orleans bottoms is the coffee pot where the liquid coffee is collected. But the difference here is that in New Orleans this coffee is the pollution and waste matter that people on the high ground/rim pour down through the ground water and the porous soil into o the lives and environment of the “Bottom” dwellers! This gives the quaint labels of, Cajuns, Getches, Bill Street entertainers a different negative and essentially racist label. They are the useful slaves, who are but a tolerated “Bottom” of society.          Rove and the Republican Criminal Propaganda machine have made these natural disasters of Hurricanes events of great political and financial advantage. They make some politicians, big business, and new TV celebrities insanely happy in large numbers.

            The discovery that "color" was the powerful key to getting the public’s emotions and sensitivities stimulated was discovered during the Lost Child advertisements. It was called an “Amber Alert!!” This amber allerte was displayed on milk cartons, new papers, TV, highway signs. The process was outstanding.  

The Home Land Security followed with this concept. They expanded it to a combination of color sensitive emotions. There was the blue, green, amber, red and then the white-hot blue white-hot color of the highest alert – the panic alert.             Hurricanes on TV start with the tropical depression in the Atlantic Ocean – the Blue green color to start, and then there is the amber color when the winds are just below hurricane velocity les than 75 miles per hour. As landfall is anticipated the color becomes an orange reddish color with the Black Hole in the center being surrounded by a white hot color of the dooms day event of the cold war era -- All this is done not so much to save lives as it is create a dynamic population, moving, running, and of course spending much, much money and providing Photo Op for the Great Savior of Commander and Thief, President G. W. Bush. It is estimated that the movement of people in these hurricane activities are about $2 to $3 thousand dollars pre family and millions of dollars per event.

 Hurricane Katrina and the accompanying floods which destroy New Orleans and other towns in Mississippi and Alabama provided the opportunity for the Bush team to executed it’s basic objective, that of profiting off of any discrepant event which includes both that caused by nature and by man made was done exceedingly well in the case of Katrina. The Rove standard plan is to rush into any situation provide misinformation, arrange for the distribution of any profitable contracts, and get any positive credit for solutions!!.  (NBC News, September, 2005).

Some of the important the important issuers and facts may be given as follows: 

Immediately during, not after, the tragedy Bush announced that oil prices would have to go up at the gas pumps (CBS News, September 2005) 

Contrary to popular opinion Bush, Rove, Cheney and the Republican Party has been exceedingly decisive in this Katrina hurricane disaster. Up front Bush, suspended Federal rules to allow FEMA and the Army Corps of Engineers to extend no-bid contracts to corporations engaged in the rebuilding. In doing so, he also allowed companies with close political ties to get to the front of the line for rebuilding contracts. In fact, On 15 Sep 2005 in a primetime speech from the flood zone, President Bush committed the federal government to what many predict will become the largest reconstruction effort ever on U.S. soil. Republicans promptly said Karl Rove, the White House deputy chief of staff and Bush's chief political adviser is in charge of the $200 billion reconstruction effort. But for some companies, especially those with political connections, Katrina -- like the war in Iraq -- is a bonanza. The prevailing wage in New Orleans is $9/hour for construction work, far below that of most other parts of the country. The Executive Order came a day after a group of 35 Republican members of Congress asked Bush to suspend the law for recovery effort. Blacks in New Orleans were placed in sports arena concentration camps as temporary holding places making big profits for big business, which were Bush’s friends. (MSNBC, September 2, 2005) America’s continuing cancer of festering racism was exposed again when Bush was deliberately slow to rescuer the many poor Blacks were moved into The Sports Arena without supplying water, food or sanitation. Many Blacks died from this mistreatment! President Bush’s mother, Barbara Bush gave the sincere feelings when she said to Texans in essence that these poor Blacks will probably want to stay in Texas and we don’t want that! 

Several Oil Rigs located in the Gulf of Mexico broke loose. One hit a bridge in Alabama destroying a large section and closing it down. Further, private oil companies have left behind the biggest oil spill in the Gulfs’ history. 

Bush announces that 100+ billion dollars will be allocated to re build area. (CNN.com, September 2005) 

Oil company’s profits go up an average of 50 %. Oil companies profit $100 Billion dollars in 2004. (NYC, 4/5/2005) This totals about $150. billion dollars per year excess profits. A significant number of private company's CEO’s received over $50 million as a bonus during the 2004 year! Why not use this money to re build New Orleans and the surrounding areas.  

Gas prices increase to record highs between 2.80 a 6.00 per gallon. In the mean time across the country, families are trying to figure out where to cut corners so they can afford gas . . . . (New York Times, 8/17/05) while . . .  oil companies are reaping huge profits. The largest oil producer in America, ExxonMobil, is estimated to see its profit increase by 47% this year alone. And, . . . . . (NBC, Today Show,8/17/05) 

Bush Does Nothing to Combat Rising Prices; . . . . As of August 16, the average gallon of gas was $2.55 a 75% increase since Bush was inaugurated in 2001. Every one-cent increase in the price of gas costs American consumers approximately $1 billion. Most of this money is going to big oil companies, who are raking in record profits even as consumers pay record prices at the pump. Instead of fixing the problem, Bush and Congressional Republicans have passed an energy bill that gives billions in tax breaks to oil companies already profiting from higher prices.  . .  . On January 17, 2005, just before Bush’s second inauguration, the average price of gasoline was $1.84 a gallon. As of August 16, 2005 the average price of gasoline is $2.55 a gallon. Why want Bush use the excess profits of oil (about $150 billion per year presently) to perfect alternative energy sources (e. g. Solar, Geothermal, hydro electric, electric cars, wind, etc to re build New Orleans and surrounding areas. Instead Bush reports that he will ask congress for about $100+ billion dollars hurricane Katrina disaster relief where oil companies are making over $100 billion per year profits with profits still rising.

FAMU, the second largest Traditionally Black Land Grant University in the US and one of the most important economic and educational engines in the Tallahassee Area has been the focus of the media attention for some time. There is not one citizen Black or white who has not tried to come to some real and logical answers about the highly visible activities in FAMU’s reorganization. What is going on?

            There are some historical activities that although are seemly unrelated may hold the answers to FAMU tumultuous agony.

·        In 2000 the Governor was caught on TV saying to two Black Legislators, “Get their Black a_ _ es out of his office.”

·        In 2000 the Governor was caught on TV saying to some FAMU students, who were demonstrating on the capital grounds in the presidential election, “Get their Black A_ _ es off the capital rounds"

·        In 2001 the Governor was alleged to have said that he would not forget FAMU for their activities doing the election 2000.

·        In 2001 then Humphries, president of FAMU resigned.

·        In 2004 the Governor was reported by The St. Petersburg Times, The Tallahassee Democrat, Palm Beach Post, Orlando Sentinel, etc. to have “Hand Picked” the present interim President as acting until January 2006. (The question here is why her and for what reason??)

·        The present interim president has replaced most all of FAMU’s existing leadership, many subordinate staff at times using a personal sole appointment procedure in neglect of normal procedures which normally include the participation of both faculty and Board.

·        FAMU lost between 15 and 30% of its student enrollment along with the $13,720 per student that they would have brought He University is income. 

Inquiring, loyal, and patriotic FAMUan and citizen have the right to ask what is going on at FAMU? The critical power holders that made these decisions (e.g. Governor, Board of Trustees, and Leadership) should tell the public  

·        1.What are the political objectives and motives provided to the appointments?  

·        2. What are the expected Educational and economic objectives of their decisions?  

·        3. Is the out come of these activities to dissolve FAMU as an institution or to strengthen this institution?  

·        4.What special talents. experiences and education does the interim leadership have that makes them qualified to reorganize this valuable institution of  higher education?          

The answers to these serious questions must be more than providing more questions such as;  

·       1. Are you questioning my integrity? Or  

·       2. Are you questioning my moral motives?

FAR RIGHT-WING JOHN ROBERTS THE RACIST, NOMINATED FOR CHIEF SUPREME COURT JUCTICE!!! 

            Just when Blacks think that their bucket is full of insults from president G. W. Bush and the Republican Far Right-Wing Evil Brigade, here comes one more insult. Today, September 5, 2005 President and Thief G. W. Bush announced that he is changing his nomination of John Roberts as a member of the US Supreme Court to a nomination for Chief Justice of The Supreme Court replacing recently deceased William H. Rehinquist!

This insult to Blacks joins a long list, which includes 

·        Refusal to meet with the Congressional Black Caucus,

·        Refusal to meet whit the National NAACP on two occasions,

·        Nomination of Uncle Clarence Thomas to the Supreme Court.

·        Assigning the IRS to investigate to NAACP and forcing Quasi Mfume to resign.

·        Disenfranchising Black voters in Elections Presidential Elections 2000 and 2004.

·        Neglecting Black citizens of New Orleans Louisiana leaving them to suffer by not sending in relief to rescue them from the floods caused by Katrina disaster in 2005. 

·        Cutting funds to The US Civil Rights Commission and subsequently replacing the commission’s leadership with another classic Uncle Tom 

·        Tried to eliminate Affirmative Action.

·        The nomination of John Roberts as Chief Supreme Justice.

Why can G. W. get away with this without any more resistance than his has been given? Well the reason may lye in the difference between Blacks who are Christian and Groups who are Muslin.

                 Christian Blacks are historically known to put resistance for a short time and after receiving rebuttal resort to praying for the rest of their lives. In contrast a Muslin, a believer in Islam will first pray for a time and get up off their knees and fright to the death for the rest of their lives- Allah Ark bar!!. A group of people who will die for their cause is much harder to defeat than a group who will wait for some divine spirit to come down and deliver them in some mysterious way.

This is why it is so much more difficult to defeat the so-called “Muslim Fundamentalist” than any other of the groups conquered by the Traditional Colonist methods.

After the Colonist Powers conquered a country they would send in their religious machine to condition the conqueror's minds to the art of non combative suffering with dignity. Only then could the riches of the Colonies be exploited with such ease. Blacks are known to be good slaves because of their proven propensity to be saved through the religion of their conqueror.

Special positions were made for those Blacks, who cooperated in keeping their people passive. The Black Mayor of New Orleans must prepare for punishment from the Administration. The rule is that no Black can be allowed to get away with defiance of any white orders and leadership!! Republicans are notoriously reliable in carrying out this creed.

American Blacks have historically heard it like this, “You are my nigger, and when you get bigger you will be my bigger nigger, when you get your Ph.D. you will be my bigger, Ph.D. nigger. You will always be my Nigger!!”

BUSH IS USING DISASTERS TO DISTRACT PUBLIC ATTENTION TO OTHER ISSUES!!! 

Well here we go again!! G. W.’s polls are showing that Americans are overcoming his propaganda and seeing him for the “Criminal Presidency” he is, Bush has ceased on the Katrina disaster to grab the opportunity to obscure his image again!!

            In 2001 G. W. ceased the 911 terrorism act and parlayed it into an positive image that took Americans attention off the fact that he and his criminal buddies, Rove, Cheney stole the presidential election in 2000.

            It is obvious that G. W. and big business profiteers use the suffering of people to exploit the minds and resources of those involved. 911 meant n opportunity for making money off donations of the public and the work of cleaning up and rebuilding structures. The Tsunami meant making money of the rebuilding of the total infrastructure of a whole region. The hurricanes meant the making of money off the scare tactic which resulted in the of moving the population into the high ways and by ways of the motels, petroleum and food Industries. Over 2 million people ran from the advertised threats of these natural disasters at a cost of about $2000,00 per family. This amounted to about $4 billion dollars paid to the frantic fleeing families. The chaos of disparate poverty and the over throw of dictators by coups are commonly used as grounds for the exploiting of these countries by big business as they rush in and take the natural resources and cheap labor of the population. The G. W.’s politicians make great popularity in this as they stand in the mist of the poor, emotional and suffering. They strand just long enough to claim any credit for small relief that may occur.

            Katrina may be one of the greatest American disasters of any time. That being true you must step back and recognize the first thing that our Leader planted as a seed to big profits. As soon as Rove stopped his dance of glee, they said immediately that the prices of gas must rise to meet the loss of the production of oil in the Gulf of Mexico!! Gasoline stations in Georgia priced gas at $5.55 per gallon and some station in Louisiana priced gas at 44.55 per gallon. Then as an after though they said that the suffering of the public will be addressed by bringing back National Guard solders from Iraq to police the area while in recovery. Then as a surprising affirmation the leaders announced that the manpower being used to rescue citizens of this hurricane would be redirected to the stopping of looting in the flooded areas. In other words the protection of the property of the rich was much more important than the saving of the lives of theses poor, suffering inner city citizens, who are left behind because they had no transpiration or resources to escape the is cataclysmic natural disaster!!

In addition, why are most of the New Orleans citizens who are left behind mostly Black? Even the busses standing by to pick up people and take them out of the city would not go to the pick-up points because there were no solders or other law enforcement personnel there to conduct an orderly loading of these buses!

Finally, Americans should be alert to the possibility that Black citizens property will not be returned and their economic status will not be honored when the city is re- constructed.

            Most importantly, our criminal administration is being successful at distracting the American form our critical issues. The Independent Press, Bloggers, and The Black and Progressive press must take the responsibility of keeping the public’s eye on the issuers of: Social Security, Roberts nomination for the Supreme Court, The Iraq War we must not allow Cindy Sheehan, the  mother of the solder, who died in Iraq be lost by media neglect, The use of illegal Immigrant Third World workers by Big Business as “Slave Labor” while making big profits off the low wages paid to these poor workers. Using The New Agency for National Security to police our cities replacing the constitutional powers of local governments. The problem of excess Profiteering by the Petroleum Industry. Instituting Election reforms before the 2006 election for Congress. ETC.

What is a “Yellow Dog Black Person?” When you accept without critical thinking and the will to criticize any man or woman because they are Black, African American, Nego, etc you are a “Yellow Dog Black Person!” The “Yellow Dog” Syndrome leaves Black American to the easy exploitation by people of Black skin, which are by their actions deliberately, hurt other Blacks and Black interest. This is why the Uncle Clarence Thomases, Ant Jamimia Condoleezza Rices, Armstrong Williams, etc. Prosper so regularly.

Ann. Lindley’s article “How loyal must a FAMUan be? “ in the August 13^th  issue of The Tallahassee Democrat is a must read for all FAMUans and the Black community as a whole. She said in essence that the process of change being conducted by the FAMU Interim Leadership is running muck without the needed scrutiny of good FAMUans. In addition, some of the so called Black Press Leaders have taken the initiative to call any Black, who makes a criticism of this FAMU process of and this “Chain Saw” style of reorganization a traitor to FAMU and a person of ill repute.

But if reality is reported how good is that that student enrollment at FAMU may be down some 30% costing the university millions of dollars income as well as denying needed students a chance at education (Board of Governor. org). How logical is it to cut Soft Money” or “Federal Grant Programs” which provide the university between 8 and 40% indirect funds and millions of dollars that are used in institutional support activities (Willie Roberts, Tallahassee Democrat, 6/6/2005). How good and acceptable is it for an interim leader to appoint administrators which in without the acceptable screening procedures which include the participation of the Board of Trustees and the faculty, etc (Malone Veagee, Bryant, Bishop too Insulting, Tallahassee Democrat, 6/14/2005).

This Yellow Dog tendency tends to spot any analysis or criticism of political objectives of the specific Black Leadership and their white mentors. Can you recall in the 2000 presidential election FAMU Students were instrumental in keeping the “Anti Bush” demonstrations alive at the capital grounds. In fact the governor told these students to get their Black a__es off the grounds. He later declared that he would not forget the activities of these students.

Bryant is a protégée of the Governor (The St. Petersburg Times, 2005) and was hand picked by him to be the interim President of FAMU. In addition, the staff, which was appointed by the president, are all friends, Deltas, Links, Republicans, and female. All this may not be bad and just coincidental, but nonetheless it is true.

FAMU has never been so vulnerable to dissolution in its history. So far about 120 FAMU employees have been fired in mass (David Kaap, St Petersburg Times, 6/1/2005). Surly there must some good people among this group (David Domron, Fired Shamed FAMU Workers feel as Audit Continues, Sentinel, 6/8/2005). If there is only one good person in this unfortunate group should not they be saved. If there is only one good man or woman in the group even God would have saved the city. of Sodom and Gomorra.

I speak as a loyal FAMUan I would like to believe that Bryant is right and she sees the ultimate solution to FAMU problems as some of us less intelligent Alumni cannot. But even in our ignorance we should have the right to make our input regardless to how contrary it may be.

Surly the FAMU Board of Trustees, the President of the Alumnus Association, the Governor of The Great State of Florida, and the Pope in Rome does not doubt this present process. I am not a big Time Rattler. I don’t even own a Newspaper. But as a poor old darkie man, three graduate degrees, patents, papers, articles, tired, all wo out, and no mo good can at least have a constructive opinion. But don’t worry at times I even miss spell words. So some say no one will take me seriously.

To really show loyalty, we all should dive an orange and green 4 MPG humbee around town, with a bobbing head governor on the dash, sporting a AK-47 rifle, with a bumper sticker which says, “America-Black Face-FAMUan; love em' or leave em'!!” That is truly a show of  loyalty, support, and FAMU patriotism!!

US 'backed illegal Iraqi oil deals'

The United States administration turned a blind eye to extensive sanctions-busting in the prewar sale of Iraqi oil, according to a new Senate investigation.
A report released last night by Democratic staff on a Senate investigations committee presents documentary evidence that the Bush administration was made aware of illegal oil sales and kickbacks paid to the Saddam Hussein regime but did nothing to stop them.

The scale of the shipments involved dwarfs those previously alleged by the Senate committee against UN staff and European politicians like the British MP, George Galloway, and the former French minister, Charles Pasqua.

MR. PRESIDENT STOP THESE ILLEGAL PYRAMID ENRON SCHEMES!!!

              Do you actually realize that our President, G. W. Bush of the U. S. A. and his men are party to the biggest “Pyramid Schemes” on a corporate level! Enron and WorldCom. The President’s personal friend heads one of which, Kenneth Lay conducted one of the largest illegal corporate “Pyramid” businesses/Schemes in history! But what si a Pyramid Scheme.

A pyramid scheme is essentially a business variation of the familiar "chain letters". It is called "pyramid" because the promoters are always at the top of the pyramid-shaped flow of money. Money coming from the later investors flows upward to the top. Being at the top will result in receiving a lot of money quickly. There are three elements to a pyramid scheme, namely: a) a participant/investors pay money (in this case in the form of stock) to the promoters/company (e.g. CEOs) in this case a corporation such as Enron. That payment entitles participant to recruit others investors or employee to invest. In Enron the participant pools were expanded to what is called “stock holders” The other participants are induced to make payments because they are told they will receive a benefit/corporate profits in respect of the introduction of those others and company growth. There is a product to be sold but this product is incidental to the money made by the continuing investors contributions.

            Here Enron and World.com were truly profitable “Pyramid Schemes.” Enron added to its illegal Pyramid the bogus sale of “(Electrical) Power” brokering. But Electrical Power is an intangible product. Enron sold power to States at profiteering prices? Electrical power is a product that is produced minute-by-minute and cannot be boxed or stored. Electrical Power is “Alternating Electrical Power.” This means that when the generators are off at the power plants there is nothing to sell. Only when this alternating power is converted to direct current, which it isn’t, can it be stored in battery banks for future use. There is nothing existing to sell. Therefore, Enron was selling a product that was and never did really exist. At he top of this Enron Pyramid Kenney “Boy,” the CEO, who collected his money in unusually large salary, Bonuses, and privileges. Out President knew this all along.

The real business of these types of dot-cons is not wholesaling products or services. It's selling the concept of the scheme itself, and investors into reselling it for them. But by law in most U.S. states, one can't profit from recruiting, with nothing changing hands but fees, paper in the form of stock, and commissions for the scheme itself. That's illegal pyramiding. But a closer look reveals that, what's really for resale is the illusion of product. This is called “Brokering” Enron style. How can the government take action against these types of frauds?

The Department of Trade and Industry (DTI) has some jurisdiction.  Article 53 under Title III on Protection Against Deceptive, Unfair and Unconscionable Sales Acts or Practices in relation to Article 4(k) of Republic Act 7394 relates to pyramid selling and the specific text read as follows: Article 53. Chain Distribution Plans or Pyramiding Sales Schemes. Chain distribution plans or pyramid sales schemes shall not be employed in the sale of consumer products. Article 4 (k)
The test in determining whether or not there is a violation of this particular provision of law is, "Does the scheme involve putting up of investment (entry fee and purchase of goods, or purchase of goods alone) for the opportunity to receive earnings derived primarily from recruiting (the selling of stock), rather from sales? Does the company have real products in their inventory? This is supplemented by ACT 3883 As Amended - Business Name Law As implemented by the Department of Trade Administrative Order (DTAO) No. 80, series of 1982 particularly Sec. 12 (d), This is intended to ultimately stop the operation of pyramiding entities registered with DTI who are taking advantage of the Business Name Registration System (BNRS) by misrepresenting the Business Name Registration Certificate (BNRC) as a permit in a desperate move to give legal semblance to their fraudulent activity.
